KEY POINTS
During an Emergency, the Central government becomes all powerful and the states go into the total control of the Centre.
Changes in the administration machinery
During a proclamation of Emergency, the normal fabric of the Centre-state relations undergoes a change.
Executive
· The executive power of the Centre extends to directing any state regarding executive power.
· The state governments are brought under the complete control of the Centre, but state legislatures are not suspended.
Legislative
· The Parliament becomes empowered to make laws on any subject mentioned in the State List.
· The laws made by Parliament on the state subjects during a National Emergency become inoperative six months after the revocation of emergency.
· The President can issue ordinances on the state subjects, if the Parliament is not in session.
Financial
· The President can modify the constitutional distribution of revenues between the centre and the states.
· Such modification continues till the revocation of national emergency.
Article 19 is automatically suspended when the national emergency is declared on the grounds of external aggression but articles 20 and 21 is not suspended.
Enforcement of Fundamental rights mentioned in the presidential order is suspended as per the article 359 of the constitution.
